General provisions

These terms and conditions are valid exclusively between Caseificio Cavola s.r.l. – Via Mauro Pagliarini, 4 – 42010 Fora di Cavola (RE) – VAT no. 03122540358, hereinafter referred to as the ”SELLER”, and any person making online purchases on the website www.993.it, hereinafter referred to as the ”CUSTOMER”. These terms and conditions may be subject to modifications, and the date of their publication on the website shall be deemed the date of entry into force.

These terms and conditions govern purchases made on the website www.993.it, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce.
ARTICLE 1 – Subject matter of the contract

By these general conditions of sale, the SELLER sells and the CUSTOMER purchases at a distance the tangible goods offered for sale on the website www.993.it. The contract is concluded exclusively via the internet network, through the CUSTOMER's access to the address www.993.it and the placing of a purchase order according to the procedure provided by the site itself.

The customer undertakes to read these general conditions of sale, in particular the pre-contractual information provided by the SELLER, before proceeding with the confirmation of their order, and to accept them by ticking the box provided.

ARTICLE 2 – Pre-contractual information for the consumer – art. 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CUSTOMER shall review the characteristics of the goods as illustrated in the individual product descriptions at the time of selection by the CUSTOMER.

Before the conclusion of the purchase contract and before validating the order with “obligation to pay”, the CUSTOMER is informed of:

total price of the goods inclusive of taxes, with a breakdown of shipping costs and any other charges;
– payment method;
– the deadline by which the SELLER undertakes to deliver the goods;
– the conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these terms and conditions) as well as the model withdrawal form set out in Annex I, Part B of Legislative Decree 21/2014;
– information that the CUSTOMER shall bear the cost of returning the goods in the event of withdrawal;
– existence of the legal guarantee of conformity for purchased goods;
– after-sales support conditions and commercial guarantees provided by the SELLER.

The CUSTOMER may, at any time and in any event before the conclusion of the contract, view the information regarding the SELLER, the geographical address, the email address, which information is also set out below:

ARTICLE 3 – Conclusion and effectiveness of the contract

The sales contract is considered concluded upon the sending by the SELLER to the CUSTOMER of an order confirmation e-mail. The e-mail contains the CUSTOMER's details and the order number, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent, and the link to be able to print and archive a copy of these conditions.

The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly notify the SELLER of any corrections.

SELLER undertakes to describe and present the items sold on the website in the best possible way. Nonetheless, some errors, inaccuracies or minor differences between the website and the actual product may become apparent. Furthermore, the photographs of the products presented on www.993.it do not constitute a contractual element, as they are merely representative.

THE SELLER undertakes to deliver the goods within 5 days from the sending by the SELLER of the order confirmation e-mail to the CUSTOMER.

ARTICLE 4 – Product availability

Product availability refers to the actual availability at the time the CUSTOMER places the order. Such availability must, however, be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other CUSTOMERS before the order is confirmed.

Even following the sending of the order confirmation email sent by VENDITORE, cases of partial or total unavailability of the goods may occur. In this event, the order will be automatically adjusted with the removal of the unavailable product and the CLIENTE will be immediately informed via email.

If the CUSTOMER requests the cancellation of the order, terminating the contract, the SELLER shall refund the amount paid within 14 days from the day on which the SELLER became aware of the customer's decision to terminate the contract.

ARTICLE 5 – Payment methods

Any payment by the CLIENT may only be made using the Credit Card payment method.

In the event of payment by credit card, the actual charge will be made when the SELLER sends the order confirmation email.

ARTICLE 6 – Prices

All product selling prices shown on the website www.993.it are in euros and include VAT.

The CUSTOMER accepts the right of the SELLER to modify its prices at any time; however, the goods will be invoiced on the basis of the prices indicated on the website at the time of order creation and indicated in the confirmation email sent by the SELLER to the CUSTOMER.

In the event of a computer, manual, technical, or any other type of error that may lead to a substantial, unforeseen change by the SELLER in the retail sales price, rendering it exorbitant or clearly negligible, the purchase order shall be considered invalid and cancelled, and the amount paid by the CUSTOMER will be refunded within 14 days of the cancellation date.

ARTICLE 7 – Delivery methods

Within 72 hours, the shipment will be handed over to the DHL express courier, which in turn will deliver it to the customer within 72 hours, barring any delays due to force majeure or the customer being unreachable. Shipping costs are calculated during order completion and vary according to the weight of the products ordered.

Pursuant to Article 63 of the Consumer Code, any damage to the packaging of the Products must be immediately disputed by the CUSTOMER by placing a written control reservation on the proof of delivery. It is understood that, once the delivery document has been signed without any dispute, you will be barred from raising any objection regarding the external characteristics of the delivered items.
In the event that the carrier has been chosen by the CUSTOMER from outside those offered during the purchase process, the risk of damage to and loss of the Products is transferred to the CUSTOMER at the very moment of delivery to the carrier itself, precluding any dispute regarding the external characteristics of what has been delivered. In this case, any dispute must be raised directly by the CUSTOMER against the carrier.

ARTICLE 8 – Right of withdrawal

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within the period of 14 days starting from the date of receipt of the products.

The CUSTOMER who intends to exercise their right of withdrawal must communicate this to the SELLER by means of an explicit declaration, which may be sent by registered letter with return receipt addressed to Caseificio Cavola s.r.l. – Via Mauro Pagliarini, 4 – 42010 Fora di Cavola (RE) or by e-mail to the address contact@993.it

The CUSTOMER may also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract. If exercising the right of withdrawal, the CUSTOMER is required to return the goods INTACT and UNUSED within 14 days from the day on which they notified the SELLER of their intention to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005.

The direct costs of returning the products shall be borne by the CUSTOMER.

The goods must be returned intact, in their original packaging, complete in all parts and without any damage.

SELLER will issue a full refund for the order (including shipping costs) using the same payment method chosen by the CUSTOMER at the time of purchase (or a different one if explicitly requested by the customer). In the event that payment was made by bank transfer, and should the CUSTOMER wish to exercise their right of withdrawal, they must provide SELLER with the IBAN bank details necessary for SELLER to process the refund by accessing the contact us section.

The CUSTOMER is solely responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

ARTICLE 9 – Legal guarantee of conformity

In the event of receiving products that do not comply with the orders or are defective, the CUSTOMER has the right to have the product's compliance restored free of charge by means of the replacement of the product itself pursuant to Articles 128 et seq. of the Consumer Code.

ARTICOLO 10 – Responsabilità

VENDITORE non assume alcuna responsabilità per disservizi imputabili a causa di forza maggiore o caso fortuito, anche ove dipendenti da malfunzionamenti e disservizi della rete internet, nel caso in cui non riesca a dare esecuzione all’ordine nei tempi previsti dal contratto.

ARTICOLO 11 – Accesso al sito

Il CLIENTE ha diritto di accedere al sito per la consultazione e l’effettuazione degli acquisti. Non è consentito alcun altro utilizzo, in particolare commerciale, del sito o del suo contenuto. L’integrità degli elementi di questo sito, che siano sonori o visivi, e la relativa tecnologia utilizzata rimangono di proprietà di VENDITORE e sono protetti dal diritto di proprietà intellettuale.

ARTICOLO 12 – Cookies

Il sito web www.993.it utilizza i” cookies”. I cookies sono file elettronici che registrano informazioni relative alla navigazione del CLIENTE nel sito (pagine consultate, data ed ora della consultazione, ecc..) e che permettono a VENDITORE di offrire un servizio personalizzato ai propri clienti.

VENDITORE informa il Cliente della possibilità di disattivare la creazione di tali file, accedendo al proprio menu di configurazione Internet. Resta inteso che questo impedirà al Cliente di procedere all’ acquisto on line.

ARTICOLO 13 – Integralità

Le presenti Condizioni Generali di Vendita sono costituite dalla totalità delle clausole che le compongono. Se una o più disposizioni delle presenti Condizioni Generali di Vendita è considerata non valida o dichiarata tale ai sensi della legge, della regolamentazione o in seguito a una decisione da parte di un tribunale avente giurisdizione, le altre disposizioni continueranno ad avere pieno vigore ed efficacia.

ARTICOLO 14 – Legge applicabile e Foro competente

Le presenti Condizioni Generali di Vendita sono sottoposte alla legge italiana.

Per le controversie civili, nel caso in cui l’acquirente sia un privato che agisce per scopi estranei all’esercizio dell’impresa o della propria attività professionale, la competenza territoriale inderogabile è del giudice del luogo di residenza o di domicilio del consumatore, se ubicati nel territorio dello Stato.

In ogni caso, è possibile ricorrere facoltativamente alle procedure di mediazione di cui al D.lgs. 28/2010, per la risoluzione di eventuali controversie insorte nell’interpretazione e nell’esecuzione delle presenti condizioni di vendita.

Si informa il Consumatore residente in Europa che la Commissione Europea ha istituito una piattaforma online che fornisce uno strumento di risoluzione alternativa delle controversie. Tale strumento può essere utilizzato dal Consumatore europeo per risolvere in via non giudiziale ogni controversia relativa a contratti di vendita di beni e servizi stipulati in rete e/o derivante dagli stessi.
Di conseguenza, se Lei è un Consumatore stabilito in Europa, può usare tale piattaforma per la risoluzione di ogni disputa nascente dal contratto online stipulato su questo sito.
